my husband's father passed awayin El Paso texas in Dec, 1990. We thought his mother inherited everything- he had no will. She died two years ago in Texas and left a will with everything to a local non profi in texas. The attorneys for the organizations are willing to apy us a modest fee, and have asked my husband sign over the deed or rights to the property as well as getting affadavidts from two people stating that he is an only son. I just found our about the prior Code sec 45 stating that my husband should have inherited 1/2 of the property. Is that one half of the full estate (the organization has already taken all the liquid funds) and is now selling the home....so does this mean that my husband actually owns half of the house...or half of the full estate. These are Texas attorneys- should they have know this? How do we rectifiy this situation? thank you for your response. We live in massachusetts and are not familar with Texas law.

Gena, we handle inheritance questions in Texas, or based on Texas law or involving people living in Texas. Your question relates to Connecticut. I would suggest that you contact an attorney there who handles estate planning. He can advise you.

My husband wont put my name on the 3 cars we have, nor his bank accounts? He tells me, that if he dies I would automatically get the cars, Is this true or am I being Bamboozeld ?

My Sister tells me the opposite, she said that if he dies, if no will everything will go to the state of connecticut ?? If she is right, I really need to convince my husband to put my name on the title of the cars. ( am I stupid or what ?? )

Thanking you in advance for your reply.

Thank you Robert.
Do you happen to know what is the period of time, which defines it to be 'too late to contest a will' ?

Thanks, Lina

The case stands for the proposition that if you are too late to contest a will, you don't have a right to exhume the deceased in order to prove that you are his heir. Whether the court would rule the same way in a case that did not involve a will contest, is unknown.

Does this mean, that in Eliza Presley’s case, where on the grounds of hairs positive DNA tests results, she could not request an exhumation of Vernon Presley’s body, because the estate was long ago distributed?

I'm so confused about how to go abpout removing a trustee. I hired an attroney who wrote several letters and left several voice mails to the trustee since the annual accounting was overdue. There are also overdue property taxes that have not been paid. He will not respond to any correspondence or voice mails. I'm not certain if he has disappeared and taken everything we own or what. What is my next step? I don't have the funds available to hire a litagator but perhaps I can take out a loan to do this and can sue for those costs?
